Terms and Conditions

SHIPPING:
All stock is priced F.O.B. Indiana, PA and is shipped bare-root.  The buyer MUST PAY FOR THE SHIPPING CHARGES and ANY EXTRA SHIPPING or pick up the order at the nursery.

All stock is shipped via UPS.  UPS is an excellent carrier for nursery stock.  Shipments have a 70lb. per carton limit.  Add 20% estimate to the total order for estimated shipping and handling* or a minimum of 10.00.  Handling includes packing materials and shipping cartons.  We recommend UPS 3 Day Select service on orders shipped to AZ, ID, MT, ND, NM, SD, UT, and WY add 40% estimate to the total order for estimated shipping and handling*.  We also recommend UPS 3 Day Select service on orders shipped to CA, NV, OR, and WA add 60% estimate to the total order for estimated shipping and handling*.   Because plants are perishable, if buyer requests ground service to these areas, we do not take responsibility for the condition of the plants upon arrival or guarantee survival. 

*In the event actual shipping costs exceed the shipping estimate, you will be billed and are responsible for paying the difference.  The items specifically marked with * will exceed the shipping estimate in most cases, on these items nursery pick-up is suggested if buyer wants to avoid extra shipping costs.  If you paid by credit card, the extra shipping charges will be billed to the same card. 

Due to our daily volume of orders, we cannot notify every customer when orders are shipped.  If you require shipment notification, please let us know and we will be happy to call or e-mail when shipments are made.   We cannot control the weather.   Late spring thaw will delay orders accordingly.  Therefore, we do not guarantee any shipping dates.  Ship dates are approximations only.

Nursery pick-ups are packaged FREE of charge.  We encourage you to pick up large transplant orders.  Due to overall fullness of plants and large root systems, most large transplant orders will exceed the shipping estimate.

SHIPPING ON HOMEOWNER SPECIALS:
Our FREE SHIPPING AND HANDLING offer now applies only to specials shipped to AL, AR, CT, DE, FL, GA, IA, IL, IN, KS, KY, LA, MA, MD, ME, MI, MO, MN, MS, NC, NH, NJ, NY, OH, PA, RI, SC, TN, VA, VT, WI, and WV.  Customers in CO, NE, OK, and TX add an additional $10.00 per special.  Shipments to all other states require air shipment.  See above for the appropriate shipping rate for your area.

PAYMENT INFORMATION:
Orders must be accompanied by full payment or a 25% deposit.  The balance of the order is due two weeks prior to the approximate shipping date.  If balance is being paid by credit card, it will be charged to the card upon shipment.  We no longer send shipments C.O.D.   There will be a $25.00 fee on checks returned NSF.

SPLIT SHIPMENTS:
Weather conditions may limit our ability to lift every nursery item at the same time.  We reserve the right to split up your order if necessary.  Please notify us if you do not want a split shipment. 

CANCELLATIONS:
Once we have started digging seedlings and transplants, it is very difficult to accept cancellations.  If the plants on your order have been dug and we are unable to sell them after a cancellation, we will be forced to destroy them at the end of the season.  Not only do we lose the order, but we also lose plants that could have been left in the field to grow for another year.  Please be careful when ordering.  Any cancellations less than 1 week prior to shipment may be subject to forfeiture of deposit and/or cancellation fee.  If plants are refused for any reason when delivered by UPS, buyer will be responsible for freight charges both ways, and/or forfeiture of deposit.

 CLAIMS/WARRANTY:
All stock is offered subject to prior sale and all orders accepted are subject to crop loss, availability of transportation facilities, strikes, government regulation, and weather.  We shall not be liable if any of the previous conditions or any other cause beyond our control prevents us from filling the order.   It is mutually agreed between the purchaser and us that our liability will not exceed the original purchase price of the product.

 We do everything possible at the nursery to ensure survival of the plants in your order.  All liability ceases when stock is delivered to the carrier.  If breakage occurs or if stock suffers through delay in transit, claim must be made on the carrier immediately.  We must be notified within 3 days after receipt of plants for problems in transit or for plants arriving in poor condition.

 Due to the many conditions beyond our control, such as possible delay or poor handling in transit, improper care immediately before and during planting, drought, fertilizer and herbicide damage after planting, etc… WE CANNOT GUARANTEE THE SURVIVAL OF OUR PLANT MATERIAL!  We warrant to deliver plants true to name as stated in our catalog.  Please report problems, damages, or shortages immediately. For your protection any formal claim must be in writing and must be received within 90 days of receipt of trees.  No claims will be considered for any reason more than 90 days after receipt.  If replacements are made for any reason, buyer is responsible for paying the freight charges.

  1. Place an order by mail, phone (800-223-7075), fax (724-463-3050) or via our secure website www.carinonurseries.com.  Checks, money orders, Visa, Mastercard, and Discover are accepted.

  2. Carefully review the terms and conditions of your order. Give the QUANTITY, VARIETY, AGE, SIZE, and CORRECT PRICE of each item you want to order.

  3. Indicate PICK-UP or UPS SHIPMENT. Due to weather conditions beyond our control we cannot guarantee shipping dates. We do our best to accommodate requests.

  4. 25% deposit is required to place your order. Balance due prior to shipment.

Pennsylvania Sales Tax
Residents of Pennsylvania are subject to 6% sales tax on stock purchased from our nursery except stock which is purchased for resale in the original form or for horticulture products (Christmas Trees and Ornamentals) in which case it will be necessary that a Sales Tax Exemption Form be Complete and mailed back to us.   Please call our office so we may send you a form, or complete the sales tax form available on our website and send it in.
